Who you are dealing with

Dote is operated by ArcSmiths LLC, in San Diego, California. You can reach a person at [email protected]. There is no ticket queue — the reply comes from someone who can actually fix the thing you are writing about.

By placing an order you agree to these terms. You need to be 18 or older to buy. We ship to the US, Canada, Australia and New Zealand. On an international order, any import duties, taxes or handling fees at the border are the buyer's to pay, not ours.

What you are buying

Two things, for one price paid once:

• Cards with an NFC chip inside — printed, or engraved, depending on the material you chose — made to the design you approve.
• The page each card opens — hosted by us, for as long as we are operating. There is no subscription, no monthly fee and no card kept on file. Changing the video later costs nothing.

Prices are in US dollars and shown before you pay. Sales tax is added where we are required to collect it. Shipping is free and tracked.

Your photographs, video and words stay yours

You keep every right you had in what you upload. You give us permission to do exactly one set of things with it: store it, print it on your cards, and show it to whoever taps those cards. That permission exists so the product can work, and it ends when you delete the content or close your account.

We will not use your photographs or video in advertising, on the site, or anywhere else, and we will not sell them. If we ever want to show a real customer's card, we will ask you first and take no for an answer.

What you upload has to be yours to upload

You confirm you have the right to use the photographs, video, music and words you give us, and that they do not break the law or infringe anyone else's rights. Do not upload material that is unlawful, that depicts a person who has not agreed to appear, or that you found somewhere and liked.

We can refuse or remove a design, and take a page down, if it appears to break this term or the law. If we do, we will tell you why. A card whose page we have removed is refundable under the refund policy.

If you collect photographs or video from guests

Any occasion card can be set to let guests upload photographs and video to your page. That feature is off unless you switch it on. By default every upload waits for your approval before it appears; you can instead choose to let uploads appear as they arrive, without waiting for you — if you do, a video cannot be screened before it is shown, only after.

Whichever mode you choose, you are the one asking your guests for their photographs and video, and you are responsible for having asked them — we are storing that material on your behalf. You can approve, reject or delete any of it at any time, and so can we if something is reported to us.

How long the page stays up

For as long as Dote is operating, which we intend to be indefinitely. We are a young company and it would be dishonest to promise forever from here.

So, the commitment we can actually keep: if we ever wind down, we will tell you with enough notice to save what is yours — we will not go quiet and let the cards die. Keep your original video file regardless. That is good advice about any company, including this one.

We may take down a page that breaks these terms, and we may move hosting or change how the page is built, provided the card keeps working.

Your account

Keep your password to yourself; you are responsible for what happens under your account. Tell us promptly if you think someone else has got into it. You can close it at any time by writing to us, and we will delete what we hold — see the privacy policy for exactly what that covers.

When something goes wrong

Cancellations, faults, losses in the post and late arrivals are all covered by the refund policy, which is part of these terms.

Beyond that: we provide the cards and the hosted page as they are. We cannot promise the page will be reachable every second of every day, or that a phone we have never seen will behave — near-field reading is a function of the handset, and some older phones have it switched off.

If we are liable to you for anything, our liability is limited to what you paid for the order it concerns. We are not liable for indirect or consequential loss. Nothing here limits liability that the law does not allow us to limit — including for death, personal injury, or fraud.

One thing worth saying plainly, because the product invites it: a Dote card is a keepsake, not a backup. Keep your own copy of any video or photograph that matters to you.

Changes

We may update these terms. The date at the top changes when we do, and the terms that apply to your order are the ones in effect on the day you placed it. If a change is significant and you have an account, we will email you.

Which law applies

California law, and the state and federal courts in San Diego, California. If a court decides one clause here is unenforceable, the rest still stands.
